Terms of Service

1. General

These Terms of Service set out the rules for using the SleepyPods online store at sleepypods.pl (the “Store”) and for buying products through it. They apply to orders placed in the US version of the Store and delivered to the United States.

The Store is operated by SleepyPods (the “Seller”, “SleepyPods”, “we”, “us”). You can contact us only:

• through the contact form in the Store.

We usually reply within 24 hours on business days.

2. Definitions

• Customer – a person who places an order in the Store.
• Consumer – a Customer who is an individual buying for purposes wholly or mainly outside their trade, business, craft or profession.
• Product – a physical item sold in the Store (for example, sleep earbuds) or an add-on service described on the product page.
• Digital content – a product supplied electronically, in particular e-books in PDF format.
• Contract – a distance sales contract between the Customer and the Seller concluded through the Store.

3. Placing an order

1. You can place orders through the Store 24 hours a day, 7 days a week.
2. To place an order, add the Products you want to your cart, enter the details needed to complete the order and choose a payment method.
3. The total price of your order, including Product prices, delivery costs and any sales tax, is shown before you place the order.
4. The Contract is concluded when we confirm acceptance of your order by e-mail to the address you provided.

4. Prices and payment

1. Prices in the US Store are shown in US dollars (USD) and do not include sales tax. Any applicable sales tax, and any import duties or fees we collect, are shown at checkout before you pay. The total shown at checkout is final unless the checkout states that additional taxes or duties may apply.
2. We accept credit and debit cards (Visa, Mastercard, American Express), Apple Pay and Google Pay, processed securely through Shopify Payments. Available methods are shown at checkout.
3. We start processing your order once payment has been received.

5. Delivery

1. We deliver to addresses in the United States. Delivery is free and every parcel is tracked.
2. We process orders within 1–3 business days of payment. Delivery usually takes 7–12 business days after dispatch. You will receive your tracking number by e-mail.
3. At peak times (for example during promotions or before holidays) delays are possible. If we cannot ship your order within the time stated, we will tell you by e-mail and give you the option to cancel your order for a full refund (in line with the FTC Mail Order Rule).

6. Digital content (e-books)

1. E-books are delivered electronically in PDF format once your order has been paid.
2. All you need to read them is a device with an app that opens PDF files.
3. Because e-books are delivered instantly, they cannot be returned once the download has started. If a file is faulty or not as described, contact us and we will fix it or refund you.

7. 365-day money-back guarantee

1. SleepyPods offers a voluntary 365-day money-back guarantee: you can return a Product within 365 days of receiving it for a refund.

8. Limited warranty and claims

1. We are responsible to you for any defect or lack of conformity of a Product that becomes apparent within 2 years of delivery. In that case we will repair or replace the Product or refund you.
2. You can make a claim by e-mail at kontakt@sleepypods.pl or through the contact form. Please include your order number and a description of the problem.
3. We will respond to your claim within 14 days of receiving it.
4. If you bought the optional Full Protection (3 years) add-on, you also have the benefits described on its product page. Add-on services do not limit your legal rights.
5. This limited warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.

9. Personal data

SleepyPods is the party responsible for Customers’ personal data. How we process it is described in our Privacy Policy.

10. Resolving disputes

If something goes wrong, please contact us first at kontakt@sleepypods.pl – most issues can be solved quickly. You may also contact your state or local consumer protection agency.

11. Final provisions

1. These Terms are governed by the law of Poland, without prejudice to the mandatory consumer protections of your state of residence, which continue to apply to you.
2. If any provision of these Terms is found invalid, the remaining provisions remain in effect.
3. Changes to these Terms do not apply to orders placed before the changes take effect.
